Fair Use Policy

1. Principle of Fair Use

This Fair Use Policy ("Policy") is designed to ensure the integrity, stability, and quality of the services provided by Curriculo ("we," "us," or "our"). Our goal is to prevent fraud and abuse that could negatively impact the experience of other users or result in unforeseen costs. This Policy outlines the acceptable use of our platform and the consequences of its violation.

2. Scope and Applicability

This Policy applies to all users of our Services, including but not limited to:

  • Candidates: Individuals using our platform to find employment opportunities.
  • Employers/Customers: Companies, organizations, and their representatives using our platform to find candidates and manage recruitment processes.

By accessing or using our Services, you agree to comply with this Policy.

3. Conditions for Candidates

Our services are provided to candidates free of charge to facilitate their job search. However, this is conditional upon adherence to this Fair Use Policy. We reserve the right to take action against any account engaged in activities deemed abusive or outside the scope of a good-faith job search, as outlined in Section 5.

4. Conditions for Employers (Customers)

We design our products to be flexible, allowing for growth through transparent, optional service upgrades. We aim to avoid unexpected costs for our customers, and the specific terms governing usage limits and overuse may be further defined in your individual service agreement.

However, this flexibility does not permit intentional misuse of the platform. The customer (company) is fully responsible and liable for the actions of its employees or any individuals accessing the service through its account. Prohibited activities, such as systematic account sharing or the use of unauthorized automation, constitute a material breach of our terms.

5. Prohibited Activities and Excessive Use

Any use of the Services that is illegal, fraudulent, or negatively impacts the service for other users is strictly prohibited. Examples of excessive or abusive use include, but are not limited to:

  • Using automated scripts, bots, or other technology to scrape data, submit applications, or interact with the platform in a manner that is excessive or inconsistent with normal, good-faith human operation.
  • Sharing a single user account among multiple individuals to circumvent subscription limits.
  • Creating an excessive number of accounts for a single entity or individual.
  • Any activity that places an unreasonable or disproportionately large load on our infrastructure, leading to a significant increase in our operational costs.
  • Uploading malicious content, spam, or deliberately false information.

6. Enforcement and Consequences

We monitor usage to ensure compliance with this Policy. If we determine, in our sole discretion, that a user has violated this Policy, we reserve the right to take any of the following actions without prior notice:

  • Temporary Suspension: We may temporarily suspend access to the account pending an investigation.
  • Permanent Deletion: For severe or repeated violations, we may permanently delete the account and all associated data.

In cases of intentional abuse that cause financial harm to Curriculo, we further reserve the right to:

  • Seek Financial Compensation: We will pursue financial compensation from the responsible party (candidate or employer) equal to the damages incurred due to the misuse.
  • Take Legal Action: We may initiate legal proceedings to protect our interests and the integrity of our platform.
  • Terminate Contracts: For customers, any violation of this Policy constitutes a material breach of contract, and we reserve the right to terminate any and all contractual obligations immediately and without refund.
